FORSYTH COUNTY -- A 30-day moratorium on lot consolidation is under effect in Forsyth County.
The move, which county commissioners approved 4-0 Tuesday, with District 3 Commissioner Todd Levent absent, appears to be the result of legal issues the county is facing, which were discussed in a closed executive session.
“One of the things we discussed in executive session is a court case that implicates our Unified Development Code, and apparently this court case has uncovered what appears to be some kind of a deficiency in the prohibitions related to lot consolidations,” County Attorney Ken Jarrard said.
Jarrard said his office would work with the county’s planning and community development staff “to correct and add some language to further confirm what properties, are in fact, subject to be consolidated.”
He said during the meeting that a public hearing on the matter would be held before the moratorium expired and will be announced at a later time.
Executive sessions are held as needed to discuss litigation, land acquisition and/or personnel and are not open to the public.
Reached later, Tom Brown, director of planning and community development, said lot consolidations are most common on agriculture and older residential zonings and typically take place when someone combines parcels to build a home.
Per the county’s unified development code, “an existing lot line forming the boundary between two lots located within the same subdivision may be removed or eliminated through the plat revision process, which conforms to the [code’s] requirements.”
If the property has no plat, a boundary survey and a “plat depicting all lots involved in the lot combination” needs to be approved.
Details around the legal issue, including the location within the county and the anticipated timeline of it being resolved, were not immediately clear.
Jarrard could not be reached later for comment, though local government and municipal attorneys usually cannot comment on ongoing legal cases.
