Cumming man charged in pedestrians death

JOHNS CREEK — A driver from Cumming faces vehicular homicide and other charges in connection with the August death of an 88-year-old Johns Creek pedestrian.

As of Thursday, 38-year-old Kristian Lee Hardy remained in custody at the Fulton County Detention Center. Bond has been set at $8,000, according to jail records. He was arrested Wednesday.

Hardy had been previously cited for failing to yield to a pedestrian in a crosswalk and fined $265.

According to Johns Creek police reports, the incident happened about 7:50 a.m. Aug. 11 at Hwy. 141 and McGinnis Ferry Road.

Hardy had reportedly stopped at a traffic light, looked to his left and moved forward to make a right turn. As he began to turn, Hardy hit Rafael Diaz Soto in the crosswalk.

Soto was carried on the hood of the car for about 10 feet, then fell to the pavement, striking his head.

Soto was taken to North Fulton Hospital, where he was initially listed in critical but stable condition with a fractured skull and internal bleeding. However, his condition worsened and he succumbed to his injuries two days later.

Hardy was traveling 5 to 10 mph at the time of impact. A Johns Creek police officer and a Forsyth County Sheriff’s deputy tested him for alcohol, with both results coming back positive. He later submitted to a blood sample at nearby Emory Johns Creek Hospital.
