Man indicted for attempting to escape Cumming police at hospital

CUMMING — A Cumming police detainee who attempted to escape custody by crawling through the air ducts at Northside Hospital-Forsyth has been indicted for that incident as well as the original charges that introduced him to law enforcement.

According to a Nov. 9 indictment report from the Forsyth County Superior Court, 23-year-old Ernest Jay Sparks faces charges of escape and criminal trespass for climbing in the ceiling of the hospital in a bathroom on Sept. 30 and crawling about 60 feet before being caught in another bathroom.

According to the indictment, Sparks “did intentionally escape from such custody and confinement” and “did intentionally damage the ceiling, property of Northside Hospital, without consent, said damage being less than $500.”

He had been taken to the hospital due to self-reported anxiety and suicidal thoughts.

According to police reports, he showed no outward signs of anxiety.

A Northside employee reportedly found Sparks in a bathroom separate from the one an officer guarded while he used the facilities.

He was supposedly attempting to climb back into the ceiling when officers pulled him down.

His reasoning for the acrobatics at the time of his arrest was, according to the report, that he “does not like jail and did not want to go back.”

Cumming police had detained him May 6 due to various drug charges, for which he was also indicted Nov. 9.

In a separate indictment, Sparks faces three counts — possession of marijuana with intent to distribute, possession of LSD and possession of drug-related objects.
