Authorities report that the autopsy of a 37-year-old man slain in a domestic shooting on Christmas Eve has been completed and new details of the shooting have been confirmed.

According to Cpl. Doug Rainwater of the Forsyth County Sheriff's Office, at about 12:30 a.m. on Dec. 24, Michael Allen Busbee of Cumming was shot and killed by his father after Busbee attacked his father with a sword, designed to be concealed inside a cane, at a residence on Berry Patch Drive in northwest Forsyth County.

From their preliminary investigation, Rainwater said that all indications point towards the son being the aggressor in the situation. Drugs and alcohol are not believed to have been a factor in the shooting.

The autopsy of Busbee also confirmed that the man was killed by one shot, giving more even more weight to a verdict of self-defense, Rainwater said.

The investigation has now been closed by the sheriff’s office and the case has been turned over to the Forsyth County District Attorney's Office for any further steps.  

"It is now up to the district attorney's office for review and determination of any criminal charges," Rainwater said.

On Friday, District Attorney’s Office Investigator John Bennet declined to comment on the case for the FCN.
